2. Definitions

• "Platform" refers to the Business Contacts Scraper web application accessible at g-maps-scraper.com.
• "Service" refers to the Google Maps business data extraction functionality provided by the Platform.
• "User" refers to any individual or entity that registers for and uses the Platform.
• "Subscription Tier" refers to the paid priority level selected by the User.
• "Scraped Data" refers to business information extracted through the Platform from publicly available Google Maps listings.

3. Service Description

Business Contacts Scraper is a SaaS platform that enables Users to search for and extract publicly available business data from Google Maps. The Service includes:

• Automated search across geographic areas using grid-based scanning
• Extraction of business names, addresses, phone numbers, websites, emails, ratings, and reviews
• Organization of results into folders and custom lists
• Export of collected data

The Platform extracts only publicly available information. We do not guarantee the accuracy, completeness, or availability of any data obtained through the Service.

4. Account Registration

To use the Service, you must create an account by:

• Registering with a valid email address and password, or
• Signing in via Google OAuth

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

5. Subscription Tiers & Payments

The Platform offers one-time payment tiers that permanently set your processing priority. Higher tiers receive faster job processing.

Payment terms:

• All payments are one-time, non-recurring charges processed via Netopia Payments
• Prices are in USD and include applicable taxes
• Your priority level is activated immediately upon successful payment
• Payments are non-refundable unless required by applicable law

6. Invoicing

• Upon successful payment, an electronic invoice is automatically issued and sent to the email address provided during checkout.
• Invoices are issued by SC NEVERBOTS SRL (CUI: 52184682) through the Oblio invoicing platform.
• Invoice series: MAPS
• Before each payment, users must provide billing details:
  • Individuals: First name, last name, address, city, country
  • Companies: Company name, VAT/CUI code, registration number, address, city, country
• Invoices are issued in USD.
• Invoice PDF is available for download from your payment confirmation email and from the admin panel.

7. Payment Processor

• All payments are processed by NETOPIA Payments (mobilPay).
• NETOPIA Payments SRL is an authorized payment institution regulated by the National Bank of Romania (BNR).
• We do not store your card details. All card data is handled directly by NETOPIA on their secure payment page.

8. Delivery

Business Contacts Scraper is a digital service. There are no physical products shipped.

• Delivery method: Electronic, via your account on g-maps-scraper.com.
• Estimated delivery term: Your priority tier is activated immediately (within a few seconds) after the payment is confirmed by NETOPIA Payments. You can start creating searches right away from your dashboard.
• Search results delivery: Once a search job is submitted, scraping typically starts within minutes (depending on your tier priority and queue position). Results are delivered to your account as they are collected and can be exported as CSV or JSON.
• Invoice delivery: An electronic invoice is automatically issued and sent to the billing email address within minutes of successful payment, via the Oblio invoicing platform.
• If your payment is confirmed but your tier is not activated within 1 hour, contact us at [email protected] and we will resolve the issue manually.

9. Return / Cancellation

Because Business Contacts Scraper is a digital service that is delivered and activated immediately upon payment, the standard 14-day withdrawal right for distance contracts (as set out in EU Directive 2011/83/EU and Romanian OUG 34/2014) does not apply once the service has been fully delivered. By completing a purchase, you give your explicit consent to begin the service immediately and you acknowledge that you lose the right of withdrawal.

Refund requests are still considered in the following cases:

• Technical failure on our side that prevents you from using the service for which you paid (e.g. priority tier not activated, platform unavailable for an extended period).
• Duplicate / accidental payment — contact us within 7 days with the order ID.
• Unauthorized payment — if you believe your card was used without your consent, contact us immediately and also contact your card issuer.

How to request a refund or cancel a subscription tier:

• Send an email to [email protected] with the subject "Refund request", including your order ID (format: sub_[userId]_[tier]_[timestamp]) and the reason for the request.
• Estimated return term: We will respond within 14 calendar days. Approved refunds are processed within another 14 calendar days and are returned via the same payment method used (bank card), through NETOPIA Payments.
• Alternatively, you can delete your account at any time from the Settings → Danger Zone section. Deleting your account immediately revokes access but does not automatically trigger a refund.

10. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to circumvent rate limits, security measures, or access controls
• Resell, redistribute, or sublicense access to the Platform without written consent
• Use the scraped data for spamming, harassment, or unsolicited communications
• Interfere with or disrupt the Platform's infrastructure or other users' access
• Reverse engineer, decompile, or attempt to extract the source code of the Platform
• Create multiple accounts to circumvent restrictions or abuse free-tier access

11. API Access & Usage

• Premium tiers (Obsidian, Titanium, Black, Onyx) include built-in API access.
• API keys are generated from the Settings page and must be kept confidential.
• API keys are hashed before storage; the full key is shown only once upon generation.
• Revoked API keys cannot be reactivated.
• API usage is subject to rate limiting (30 requests/minute for search creation).
• We reserve the right to revoke API access for misuse.

12. Intellectual Property

The Platform, including its design, code, algorithms, and branding, is the intellectual property of SC NEVERBOTS SRL. You may not copy, modify, or distribute any part of the Platform.

Data extracted through the Service originates from publicly available sources. We make no claim of ownership over the scraped data. You are responsible for your use of such data.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied
• We do not guarantee uninterrupted, error-free, or secure access to the Platform
• We are not liable for the accuracy or completeness of any scraped data
• We are not responsible for any indirect, incidental, or consequential damages arising from use of the Service
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim

14. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Google Maps may change their platform at any time, which could affect the Service's functionality. We reserve the right to modify or discontinue features with reasonable notice.

15. Termination

We may suspend or terminate your account if you violate these Terms or engage in activities that harm the Platform or other Users. You may delete your account at any time from the Settings page.

Upon termination, your access to the Platform and any stored data will be permanently removed. Paid subscription tiers are non-refundable upon termination for cause.

16. Data Protection

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Romanian data protection laws. For full details on how we collect, use, and protect your data, please see our Privacy Policy.

17. Consumer Rights & Alternative Dispute Resolution

According to OG 38/2015 and ANPC Order 449/2022, consumers have the right to use alternative dispute resolution (SAL) procedures for resolving disputes with merchants.

• If you are not satisfied with our response to a complaint, you may use the SAL (Soluționarea Alternativă a Litigiilor) platform provided by ANPC.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania. Any disputes arising from or related to these Terms shall be resolved by the competent courts in Timișoara, Timiș County, Romania.
